Terms and condition for Mutawwif(ah)

This agreement is between JOOMM UMRAH DIY, and the MUTAWWIF(AH). The MUTAWWIF(AH) is registering with JOOMM UMRAH DIY, collectively referred to as the "Parties." By registering as a MUTAWWIF(AH) on the JOOMM UMRAH DIY platform, the MUTAWWIF(AH) agrees to be bound by the following terms and conditions:

1. Registration and Eligibility

   a. The MUTAWWIF(AH) must complete the registration process on the Company's platform and provide accurate and up-to-date information.

   b. The MUTAWWIF(AH) warrants that they are legally eligible to provide tour services in the locations where they operate and will comply with all applicable laws and regulations.

   
   

2. Platform Usage

   a. This company provides an online platform for MUTAWWIF(AH) to register and offer their services to clients.

   b. This company grants the MUTAWWIF(AH) a non-exclusive, non-transferable license to access and use this company's platform solely for the purpose of providing tour services to clients registered on the platform.

   c. The MUTAWWIF(AH) agrees not to use the platform for any unlawful or unauthorized purpose and to comply with all platform guidelines and policies.

   
   

3. Service Provision

   The MUTAWWIF(AH) agrees to provide tour services to clients registered on this company's platform in accordance with the terms agreed upon with each client.

   This MUTAWWIF(AH) is solely responsible for the quality, safety, and legality of the tour services provided to clients.

   
   

4. Responsibilities of the MUTAWWIF(AH)

   a. The MUTAWWIF(AH) is solely responsible for setting their own rates, charges, and terms of service.

   b. The MUTAWWIF(AH) must maintain the necessary licenses, permits, and insurance required to provide tour guide services.

   
   

5. Booking and Liability

   a. This company will not arrange bookings between customers and the MUTAWWIF(AH) via its platform but merely offer the space and data to help both parties

   b. The MUTAWWIF(AH) promises to respect all reservations made through our platform and to provide customers with the agreed travel services

   
   

6. Client Interactions

   a. The "MUTAWWIF(AH) is responsible for communicating directly with clients, including but not limited to discussing charges, arranging payments, and providing services.

   b. This company is not involved in and does not assume any responsibility for any disputes, conflicts, or issues arising between the MUTAWWIF(AH) and their clients, including but not limited to charges, costs, value, or services provided.

   
   

7. Liability

   a. The MUTAWWIF(AH) acknowledges and agrees that this company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Company's platform.

   b. The MUTAWWIF(AH) agrees to indemnify and hold harmless this company, its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses (including legal fees) arising out of or in connection with the MUTAWWIF(AH) use of the company's platform or provision of tour guide services.

   
   

8. Registration Fee

   The MUTAWWIF(AH) agree to pay an annual registration fee of RM 210.00 to "JOOMM UMRAH DIY"upon signing this agreement and annually thereafter. This fee covers the administrative costs associated with registering the tour guides on the agency's platform. 

9. Publication on Platform

   In exchange for the registration fee, JOOMM UMRAH DIY agrees to publish the names of the MUTAWWIF(AH) on its platform for a period of one year from the date of payment. This publication allows the MUTAWWIF(AH) to showcase their services and attract potential clients through the agency's platform.

10. Renewal

    The registration fee is payable annually, and the MUTAWWIF(AH) must renew their registration each year to maintain their listing on the JOOMM UMRAH DIY platform. Failure to renew the registration within , 30 days of the expiry date will result in the removal of their names from the platform.

11. Non-refundable Fee

    The registration fee is non-refundable, regardless of whether the MUTAWWIF(AH) decide to continue using the agency's platform for the entire year. Once paid, the fee cannot be reimbursed under any circumstances. 

12. Ratings and Reviews

    Clients may provide ratings and reviews of the MUTAWWIF(AH) services on the Company's platform.

    The MUTAWWIF(AH) acknowledges that ratings and reviews may affect their reputation and standing on the platform and agrees to provide high-quality services to clients.

    
    

13. Confidentiality

    The Parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of their business relationship.

    
    

14. Termination

    a. Either Party may terminate this Agreement with written notice to the other Party.

    b. The company reserves the right to terminate or suspend the MUTAWWIF(AH) access to the platform at any time, with or without cause.

    c. In the event of termination, the JOOMM UMRAH DIY will remove the names of the MUTAWWIF(AH) from its platform within a reasonable time frame.

    d. Upon termination, the MUTAWWIF(AH) agrees to cease using the company's platform and to fulfill any outstanding obligations to clients.

    
    

15. Indemnification

    The MUTAWWIF(AH) agrees to indemnify and hold harmless the Company from any claims, damages, or liabilities arising out of the MUTAWWIF(AH) provision of tour services.

    
    

16. Change of Terms

    The JOOMM UMRAH DIY reserves the right to modify the terms and conditions of this agreement, including the registration fee, at its sole discretion. Any changes will be communicated to the freelance tour guides in writing, and their continued use of the platform will constitute acceptance of the modified terms.

    
    

17. Governing Law and Dispute Resolution

    a. This Agreement shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

    b. Any disputes arising under this Agreement shall be resolved through negotiation and mediation in good faith.

    c. If a resolution cannot be reached, either Party may pursue legal remedies as provided by law.

    
    

18. Entire Agreement

    This Agreement constitutes the entire agreement between the MUTAWWIF(AH) and the company regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.
